Healthcare providers are faced with the possibility of a governmental billing audit. Should an audit arise, a Billing Errors & Omissions policy will provide reimbursement of costs that arise during the investigation. These costs include defense and appeal of a claim alleging billing errors, fines and penalties for billing errors, and violations of HIPAA.
Cyber Liability
Cyber liability coverage protects physicians against regulatory and liability claims arising from the theft, loss, or accidental transmission of confidential patient or financial information as well as the cost of data recovery. Coverage varies from company to company, but most provide the following:
Patient notification and credit monitoring costs including all reasonable legal, public relations, advertising, IT forensic, credit monitoring and postage expenses incurred by the insured for notifying a third party of a privacy breach.
Data recovery costs including all reasonable and necessary sums required to recover and or replace data that is compromised, damaged, lost, erased or corrupted by non-property perils.
Network security and privacy insurance including third party liability coverage for allegations of privacy violations of both electronic and paper records, as well as failure to prevent transmission of malicious software code. Coverage would include virus attacks, denial of service attacks, identity theft, and more.
Regulatory fines and penalties insurance including coverage for fines/penalties for violations of privacy regulations, including but not limited to HIPAA, Gramm Leach Bliley and HITECH.
Cyber extortion insurance that covers costs and expenses related to a credible threat, including a demand for money.
Most companies provide a limit of up to $50,000 per claim subject to a $50,000 aggregate. This coverage is provided at no cost by a number of malpractice insurance carriers. Higher limits may be available depending on the carrier.
